1. Agreement to these Terms

These Website Terms of Use (the "Terms") govern your access to and use of www.dbcapitalgroup.ca (the "Site"), operated by DB Capital Group, an unregistered sole proprietorship based in British Columbia ("DB Capital Group", "we", "us"). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site. DB Capital Group is the parent business of Hometown Websites and Lunar Capitol Supply.

2. Definitions

"Content" means all text, graphics, images, logos, designs, code, data and other material on the Site. "You" means the individual using the Site and, if you use it on behalf of a business, that business.

3. Permitted use

You may view and use the Site for your own lawful, non-commercial information purposes. You must not: (a) copy, reproduce, republish, scrape, frame or create derivative works from the Content except as expressly permitted; (b) attempt to gain unauthorised access to the Site, its servers, the client portal or administrative areas, or test their vulnerability; (c) introduce malware or interfere with the Site's operation; (d) use the Site to send unsolicited messages or to collect information about other users; or (e) use the Site in breach of any law.

4. Intellectual property

The Site and its Content are owned by or licensed to DB Capital Group and are protected by the Copyright Act and the Trademarks Act (Canada) and international treaties. All rights not expressly granted are reserved. DB Capital Group, DB Capital Group and the associated crests and logos are trademarks (™) of DB Capital Group. Nothing on the Site grants a licence to use any trademark without our prior written permission.

5. No financial, investment, legal or tax advice

The Site describes the private investment interests of DB Capital Group. Nothing on the Site is investment, financial, legal, tax, accounting or real estate advice, a recommendation, or an offer or solicitation to buy or sell any security or other investment. Our full Investment & Financial Information Disclaimer forms part of these Terms and you must read it before relying on anything on the Site.

6. Market data

Market data, charts and quotes are supplied by third parties (including TradingView and links to Yahoo Finance), may be delayed, indicative (including CFD-derived index values) or inaccurate, and are provided for general information only. Do not rely on them for trading decisions.

7. Voluntary support

Any payment made through the "Support" link is a voluntary gift to DB Capital Group. It is not an investment, loan, deposit or purchase; it does not give you any ownership, profit share, return, goods, services or other rights; it is not tax-deductible (DB Capital Group is not a registered charity); and it is non-refundable except where required by law or in cases of payment error or fraud reported within 30 days.

Accuracy and availability

We take reasonable care to keep the Site accurate and current, but the Content is provided for general information and may contain errors or become out of date. We may change, suspend or discontinue any part of the Site at any time without notice.

Third-party links and content

The Site may link to or embed third-party websites and content. We do not control and are not responsible for them, and a link is not an endorsement.

Disclaimer of warranties

To the fullest extent permitted by law, the Site and Content are provided "as is" and "as available", without warranties or conditions of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of or inability to use the Site, and our total liability for any claim relating to the Site is limited to C\$100. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including the Business Practices and Consumer Protection Act (British Columbia) (https\://www.bclaws.gov.bc.ca/civix/document/id/complete/statreg/04002_00). Any agreement for paid services is governed by its own terms.

Indemnity

You agree to indemnify us against claims, losses and reasonable costs (including legal fees) arising from your breach of these Terms or misuse of the Site.

Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. The courts of British Columbia (and, for claims within its jurisdiction, the Civil Resolution Tribunal, https\://civilresolutionbc.ca/) have exclusive jurisdiction, except where consumer protection law gives you the right to bring a claim elsewhere.

General

If any provision of these Terms is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver. We may update these Terms by posting a new version with a new "Last updated" date; continued use after that date means you accept the updated Terms.

1. Purpose of the Site

DB Capital Group is a private investment vehicle that invests its own capital. It does not accept money from the public, manage assets for others, offer securities, provide investment, retirement, trading or real estate services to the public, or act as an adviser, dealer, portfolio manager, mortgage broker or real estate licensee. DB Capital Group is an unregistered sole proprietorship.

2. Not advice; not an offer

All content on the Site, including any material published by its Retirement, Trade (equity and markets) and Property (real estate) desks, company and fund lists, themes, commentary, market data, links and future rental or development listings, is general information about our own interests only. It is not:

  • investment, financial, retirement, tax, legal, accounting or real estate advice;
  • a recommendation or endorsement of any security, fund, digital asset, commodity, property or strategy;
  • a prospectus, offering memorandum or an offer or solicitation to buy or sell any security or interest, in any jurisdiction; or
  • tailored to your objectives, financial situation, risk tolerance or needs.

DB Capital Group is not registered with the British Columbia Securities Commission, the Canadian Investment Regulatory Organization or any other securities regulator in any capacity, and is not licensed under the Real Estate Services Act (British Columbia).

3. Risk

Investing involves risk, including the possible loss of all capital. Equities, digital assets (such as Bitcoin, Ethereum, Solana and XRP), commodities, leveraged and derivative products and real estate can be volatile and illiquid. Thematic and concentrated exposure (for example, to space, energy or semiconductors) increases risk. Past performance is not a guide to future results, and no performance, return or outcome is stated, implied or promised by any statement, slogan or image on the Site.

4. Positions and conflicts

DB Capital Group and its principal may hold, buy or sell any security or asset mentioned on the Site at any time, without notice, and may have done so before or after publication. Inclusion on a list is not a disclosure of a position or size.

5. Third-party information

Market data (including TradingView widgets and Yahoo Finance links) and REALTOR.ca and other third-party links are provided for convenience. They may be delayed, indicative or inaccurate, and we receive no compensation for them unless expressly stated.
